During that time he has dealt with catastrophic injuries, fatal accidents and psychiatric damage. He also has gained expertise in dealing with occupational disease work. In more recent years, he has developed an expertise in construction personal injury claims acting for major public limited companies in respect of a wide range of claims including incidents involving cranes, scaffolding, refuse operations and stress at work.

Public Sector Risk

Guy’s experience covers the full range of risks to which public sector clients are usually exposed.

Insurance/Re-Insurance

Guy has advised and acted on behalf of insurers in relation to claims notification issues, coverage disputes, non-disclosure, waiver, mis-representation, policy interpretation, application of retroactive cover and the Third Party (Rights Against Insurers) Act.

Property/Construction

Guy has handled a variety of claims including those involving subsidence and surveying issues.

Examples of cases that Guy has handled include:

  • A claimant sought damages from her employer for harassment under the Protection from Harassment Act. The allegations were numerous and included failure to deal with a dispute over wages, arguments over working hours, gossip about personal matters, requiring her to sign a register of attendance and general victimisation.
  • Guy represented a main contractor who subcontracted the demolition of a wall to subcontractors. An employee of the subcontractors sustained injury when the wall collapsed.  The case involved issues of law as to the respective liabilities of the parties
  • A claimant fell from an unfooted ladder. There were complex issues as to the ownership of the ladder, the responsibility of the owner as distinct from that of the employer, whether the claimant was in fact self-employed and whether that relieved the defendants of liability.
  • Guy represented a contractor who was instructed by a local authority to begin works to construct a pedestrian crossing.  The local authority changed its mind after the works had begun and while the parties were deliberating about how best to reinstate the area, a claimant sustained injury.
  • Scaffolding cases, where we represent the main contractor and there are disputes about whether a faulty scaffold is the responsibility of the scaffolding subcontractor.
  • Accidents on building sites involving major injuries.
