Insurance

At Watmores insurance is at the heart of what we do. A claim involves not only an assessment of liability and quantum but must include careful consideration of the policy of insurance itself.

We take the view that if we are instructed early in a claim we are best placed to investigate the applicability of a policy of insurance. We can provide early advice on coverage disputes, including late notification, non disclosure and misrepresentation and breach of terms and conditions. It is imperative that such issues are resolved quickly and effectively at an early stage, particularly as coverage disputes can damage an Insurer’s reputation if handled badly.

We will investigate the claim to identify any fraud on the part of the policy holder and quickly resolve any dispute by close and effective partnerships with insurers and loss adjusters.

Our lawyers have a great deal of experience in handling policy issues and have recently had a case involving the interpretation of a public liability policy of insurance of a major UK insurer proceed to the Court of Appeal. We have also launched proceedings on the interpretation of an employer’s liability policy in mesothelioma cases which is likely to be a substantial and important piece of litigation.

Fraud

At Watmores we do not consider insurance fraud to be a victimless crime. We employ litigators with considerable experience in identifying the tell-tale signs of fraud which enables us to assist our clients in the selection of the correct claims to investigate and expose the fraud at an early stage.

Where a claim has been successfully defended and dismissed for fraud we will consider whether it is in the interest of the client to seek permission from the Courts to pursue the claimant for contempt of court as a deterrent to others.
